Terms of Service

1. Acceptance of Terms
By accessing or using any service provided by Pulser ("we", "us", or "our") -- including the pulser.fit website, the Pulser.Gym platform, the Pulser.One application, and the Pulser.Coach tools (collectively, the "Services") -- you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.
If you are using the Services on behalf of a gym, fitness facility, or other organisation, you represent that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and the organisation.
2. Description of Services
Pulser provides a suite of interconnected fitness technology products:
Pulser.Gym is a gym management SaaS platform designed for fitness facility operators. It provides tools for member management, attendance tracking, equipment monitoring, class scheduling, billing, and facility analytics.
Pulser.One is a member-facing fitness application that includes an AI-powered coach, body scan capabilities, movement tracking and analysis using your phone's camera, and integrations with wearable devices including Apple Health, Garmin, Whoop, Oura, and Fitbit.
Pulser.Coach provides tools for fitness coaches and personal trainers to manage their clients, design programmes, review movement analysis data shared by their clients, and track client progress across the Pulser ecosystem.
3. Accounts and Registration
To use most features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update that information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 16 years of age to create an account. By creating an account, you represent that you meet this age requirement. We reserve the right to suspend or terminate accounts that we reasonably believe were created by individuals under 16.
4. Subscriptions and Billing
Pulser offers both free and paid subscription tiers across its products. Free tiers provide access to core functionality with certain limitations. Paid plans unlock additional features, higher usage limits, and premium capabilities as described on our pricing page.
Paid subscriptions are billed either monthly or annually, depending on the plan you select. Annual plans are billed in advance for the full year. All prices are displayed inclusive of applicable taxes unless stated otherwise.
You may cancel your subscription at any time through your account settings. If you cancel a monthly plan, your access to paid features continues until the end of the current billing period. If you cancel an annual plan, your access continues until the end of the annual term. We do not provide prorated refunds for partial billing periods unless required by applicable law.
We reserve the right to change our pricing with 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the new pricing takes effect.
5. Acceptable Use
You agree to use the Services only for their intended purposes and in compliance with all applicable laws. You may not use the Services to engage in any activity that is illegal, harmful, or disruptive to other users or to the operation of the Services.
Without limitation, you agree not to: attempt to reverse-engineer, decompile, or extract source code from any Pulser software; interfere with or disrupt the integrity or performance of the Services; attempt to gain unauthorised access to other users' accounts or data; use the Services to transmit malware or engage in phishing; scrape, crawl, or otherwise automatically extract data from the Services without our written consent; or resell, sublicense, or redistribute access to the Services except as expressly permitted under a Pulser partner agreement.
6. Intellectual Property
The Services and all associated technology, including but not limited to the Pulser movement engine, body scan algorithms, AI coaching models, and the software architecture underlying the platform, are the proprietary intellectual property of Pulser. These Terms do not grant you any ownership rights in the Services or our technology.
The Pulser name, logo, and product names (Pulser.Gym, Pulser.One, Pulser.Coach) are trademarks of Pulser. You may not use these marks without our prior written permission, except to the extent necessary to refer to our products in a factual, non-misleading manner.
7. User Content and Data
You retain ownership of all data and content you provide to the Services, including your workout data, body scan results, and any information you share with coaches or gyms through the platform. By using the Services, you grant Pulser a limited licence to process, store, and display this data solely for the purpose of providing and improving the Services.
We do not claim ownership of your personal data. Our use of your data is governed by our Privacy Policy, which forms part of these Terms. You can export or delete your data at any time as described in the Privacy Policy.
8. Cross-Gym Network
Pulser enables a network of connected fitness facilities. If your gym participates in the Pulser network, your membership may grant you access to other participating gyms under the terms of your subscription plan and the policies set by each individual facility.
Access to network gyms is subject to availability, capacity limits, and any restrictions set by the host facility. Your home gym's membership terms take precedence, and network access is a supplementary benefit that may be modified or withdrawn with reasonable notice. Each gym in the network retains full control over its own access policies, pricing, and facility rules.
9. Disclaimers
Not medical advice. The Services, including the AI coach, movement analysis, body scan, and any data derived from wearable integrations, are intended for general fitness and wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any new exercise programme or if you have concerns about your health. Do not disregard professional medical advice or delay seeking it because of information provided through the Services.
Not a replacement for professional coaching. While the AI coach provides personalised workout suggestions and form feedback, it is not a substitute for in-person professional coaching or personal training. The AI coach's recommendations are generated algorithmically and may not account for all individual circumstances, injuries, or conditions.
Service availability. The Services are provided "as is" and "as available." We make reasonable efforts to ensure uptime and reliability but do not guarantee uninterrupted, error-free operation. We may suspend access for maintenance, updates, or circumstances beyond our reasonable control.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Pulser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Services, regardless of the theory of liability.
Our total aggregate liability for any claims arising from or related to the Services shall not exceed the amount you have paid to Pulser in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (EUR 100), whichever is greater. Nothing in these Terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable law.
11. Termination
You may terminate your account at any time by contacting us at go@pulser.fit or through your account settings. Upon termination, your right to use the Services ceases immediately, though we will retain your data for a limited period as described in our Privacy Policy to allow you to export it.
We may suspend or terminate your account if we reasonably believe you have violated these Terms, if your account has been inactive for an extended period, or if we are required to do so by law. Where possible, we will provide notice before termination and give you an opportunity to export your data.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice in the Services at least 30 days before the changes take effect. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance. If you do not agree to the updated Terms, you should stop using the Services and close your account before the changes take effect.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which Pulser is established. Any disputes arising from or relating to these Terms or the Services shall be resolved in the competent courts of that jurisdiction. If you are a consumer resident in the EU, you also retain the benefit of any mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
